When must I file and pay my taxes?
Companies must file within 6 months after year-end. Individuals file by March 31 of the following year. From January 2026, all taxpayers must also make monthly installment payments.

Can tax officials seize my car or business assets?
Yes, but only under strict conditions. Officials may seize goods and vehicles from business premises after 7 days written notice. They CANNOT raid your private home unless it is your registered business address. Seized goods cannot be sold for 5 days, giving you time to pay and reclaim them.

Can I be imprisoned for not paying tax?
Not simply for inability to pay. Civil penalties apply for unpaid tax. However, deliberately filing false returns or hiding income can result in a fine of ₦500,000–₦2,000,000 and/or up to 3 years imprisonment.

What if I disagree with my tax assessment?
You have 30 days to lodge a formal objection. If unresolved, appeal to the Tax Appeal Tribunal within a further 30 days. You must pay the undisputed portion of the tax before the Tribunal will hear your case.

Am I entitled to a tax refund if I overpaid?
Yes. Apply in writing to NRS within 6 years. NRS must respond within 90 days and pay within 45 days of approval. Late refunds attract interest at the CBN monetary policy rate.

How do I prevent extortion by tax officials?
Know your rights. Officials cannot demand cash. Always request an official assessment notice and pay only through NRS official channels. Document every interaction. Report extortion to the NRS Internal Affairs Unit or EFCC.

Can tax officials raid my home?
No. Distrain powers apply only to business premises. A private home cannot be raided unless it is also your registered business address. If officials attempt an unlawful raid, refuse entry, call the police, and apply to the Tax Appeal Tribunal immediately.

Does my employer PAYE cover all my taxes?
If employment is your only income, yes. But if you have freelance, rental, or business income, you must separately declare and pay tax on those amounts through self-assessment.

What is the penalty for late payment?
₦100,000 for the first month of default, then ₦50,000 per subsequent month, plus interest at the CBN monetary policy rate.

Are churches, NGOs and charities tax-exempt?
Yes, provided they obtain a Tax Exemption Certificate from NRS. Income from ecclesiastical, charitable or educational institutions of a public character is fully exempt.

I pay contractors and freelancers. Do I need to deduct WHT?
Yes. As the payer you are legally required to deduct Withholding Tax before making any payment for consultancy, technical or professional services. The rate is 5% for Nigerian resident individuals or companies. You must remit to NRS by the 21st of the following month and issue a tax credit certificate to the contractor. The contractor pays no extra — WHT is deducted from what you would have paid them and credited against their own tax. Failure to deduct attracts a 10% penalty on every undeducted amount, applied retroactively if audited.

Do I pay CIT, VAT, WHT and CGT all at once?
No. Each is triggered by a different event. CIT is annual, on profits. VAT is monthly and flows through your business to NRS. WHT is deducted when you make qualifying payments to contractors. CGT is only paid when you sell an asset. You pay each only when its trigger occurs.

When must I register for VAT?
Registration is mandatory once annual taxable sales reach ₦25,000,000. Below that threshold, registration is voluntary. If unregistered, you cannot charge VAT on invoices or recover input VAT on purchases. Penalty for late registration is ₦50,000 plus 10% of VAT that should have been charged.

My turnover is below ₦50M. Am I exempt from all taxes?
From 1 January 2026, you are exempt from CIT and Development Levy if turnover does not exceed ₦50M and total fixed assets do not exceed ₦250M. This exemption does not apply to professional service firms such as legal, accounting, medical or consulting businesses. VAT obligations still apply if sales exceed ₦25M, and WHT must still be deducted from contractor payments.

I sold a property this year. Do I owe CGT on top of my CIT?
Yes. Capital Gains Tax is separate from CIT and is triggered by disposal of a chargeable asset. For companies, CGT is 30% on the gain under NTA 2025 (same rate as CIT). Small companies are exempt. Individuals pay CGT at the same progressive PIT rates. Your principal private residence is exempt once in your lifetime. Investment property, business equipment and shares above ₦150M proceeds are all chargeable.

I earn income in USD. How is it taxed?
Foreign currency income is converted to Naira at the CBN official exchange rate for the period. Use the CBN rate for each month the income was received when filing. This app converts at the current indicative rate for estimation only.

Can I deduct my home office?
Yes under NTA 2025 Section 32. Deduct the proportion of rent and renovation costs that relates to your business use. One business room out of five total rooms means 20% of costs are deductible. Keep documentary evidence and be prepared to justify the allocation if audited.

What is the Nigeria Startup Act and does it reduce my taxes?
The Nigeria Startup Act 2022 allows eligible technology-driven companies to apply for a Startup Label from NITDA. Benefits include a 5% WHT rate on fees paid to non-resident technical service providers instead of 10%, plus other incentives. Your company must be Nigerian-registered, not older than 10 years, and have technology as a core part of operations.

I have never filed taxes. What happens if NRS finds out?
NRS can assess back taxes up to 6 years for non-filing, or indefinitely where fraud is involved. Penalties include 10% of unpaid tax per annum plus CBN interest. Criminal prosecution is possible for deliberate evasion. The best course is voluntary disclosure before you are audited — penalties are typically reduced and prosecution is rarely pursued for good-faith disclosures.

I trade cryptocurrency. Is that taxable?
Yes. Under NTA 2025 Section 4, profits from transactions in digital or virtual assets are explicitly chargeable income. Crypto traders and NFT sellers must include gains in their taxable income. Individuals pay at progressive PIT rates, companies at 30%. Keep records of every transaction.

How do I file for 2025 under old rules vs 2026 under NTA 2025?
For your 2025 year of assessment, file under the old Companies Income Tax Act: 0% below ₦25M turnover, 20% between ₦25M and ₦100M, 30% above. NTA 2025 applies from 1 January 2026. For 2026, the rate is 30% for non-small companies and 0% for qualifying small companies (turnover ≤₦50M, fixed assets ≤₦250M, non-professional services).
